By signing this waiver, I acknowledge that it covers my participation in activities including but not limited to Escape Rooms, Indoor Playland, and Nerf Wars hosted by Starved Rock Entertainment. I fully understand and accept the risks associated with these activities and release the organizers from any liability to the maximum extent permitted by law.

I, the undersigned participant (or parent/legal guardian of the participant), hereby acknowledge that I am fully aware of the risks and hazards connected with the activities which may take place at Starved Rock Entertainment, including but not limited to falls on or from the equipment, tripping, collisions with the equipment or with other participants. I understand that such activities include the risk of injury and even death, and I hereby elect to voluntarily participate in said activities, knowing that they may be hazardous to my property and me. I understand that Starved Rock Entertainment does not require me to participate in these activities, and I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, whether caused by the negligence of releasees or otherwise, to the fullest extent allowed by law.

I understand that adult supervision of each child by that child’s parent or authorized caregiver is required at all times. Starved Rock Entertainment shall not be liable for any injury resulting from an absence of adult supervision, including, but not limited to, any child leaving the property of Starved Rock Entertainment without a parent or caregiver.

I understand that my agreement and completion of this Waiver on the first visit will authorize Starved Rock Entertainment to use it as a continuous waiver for my child’s/children’s ongoing participation in the activities or use it as a waiver executed for my other child/children. I hereby expressly authorize Starved Rock Entertainment to use this Waiver as a multi-use waiver until I have expressed to change this in writing.

I further hereby agree to indemnify and hold harmless the releasees from any loss, liability, damage, or costs, including court costs and attorneys’ fees, that Releases may incur due to my participation in said activities, whether caused by negligence of releasees or otherwise, to the fullest extent allowed by law.

ESCAPE ROOMS AND NERF WARS

I hereby assume all of the risks of participating in any and all activities associated with the escape room game and Nerf wars hosted by Starved Rock Entertainment, including, by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I understand this activity has potential risks, including but not limited to:

Use of simple tools,
Potentially moving or hinging objects of not more than twenty pounds,
Mental stress and anxiety,
Being in a reasonably small space with up to ten persons,
Possibility of failure to escape the room in the allotted time.
I confirm that I have paid in full for this activity, and I understand any refund policies posted on the website. I understand that I am responsible for the replacement or repair of any prop, fixture, surface, etc., due to intentional damage. I have no physical or mental illness that precludes my participation in a safe manner for myself or others. I am not under the influence of drugs or alcohol that impairs my ability to maintain my safety awareness or endangers others.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity. I agree that all staff or authorized agents may, in their sole discretion, determine it is unsafe for myself or others for my participation to continue and remove me from the premises by any lawful means.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me, THE FOLLOWING ENTITIES OR PERSONS: The directors, officers, employees, volunteers, representatives, and agents of any and all entities authorizing this activity.

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise. I acknowledge that the directors, officers, employees, volunteers, representatives, and agents of any authorizing entity are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose this authorizing entity decides, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
